Terms of Service — Customers

1. Agreement to Terms

By accessing or using the 5Junk platform ("Platform"), operated by 5Junk.com ("Company," "we," "us"), you ("Customer," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms constitute a legally binding agreement between you and the Company. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

2. Platform Overview

5Junk operates as a lead marketplace that connects customers who need junk removal services ("Customers") with independent junk haulers ("Haulers"). When you submit a request through the Platform, your information may be shared with one or more qualified Haulers in your area.

5Junk does not perform junk removal services. We act solely as a technology intermediary connecting you with independent Haulers. We do not employ, direct, or control any Hauler.

3. Customer Eligibility

To use the Platform, you must:

• Be at least 18 years of age.
• Provide accurate and complete information, including your name, phone number, email address, and the details of your junk removal needs.
• Be the authorized owner or authorized agent of the property where junk removal services are requested.
• Have a legitimate need for junk removal services.

4. Lead Submission

When you submit a request, you represent and warrant that:

• All information you provide is truthful, accurate, and not misleading.
• You are genuinely seeking junk removal services in the area specified.
• You have not submitted the same request through multiple accounts or with false contact details.
• Any photos or videos uploaded accurately represent the junk removal job.

Fraud Detection: We employ automated fraud detection systems that analyze submissions for suspicious patterns. Requests flagged as potentially fraudulent may be blocked or reviewed before distribution. Repeat abuse may result in a permanent ban from the Platform.

5. How Your Request Is Handled

Once submitted, your request enters our marketplace where:

• Your request is evaluated based on job details (junk type, urgency, location, access conditions, photo/video quality).
• One or more licensed Haulers in your area may respond with a quote and message for your review.
• You may receive quotes from up to 3 haulers and can choose the one that best fits your needs.
• In some cases, a single hauler may be assigned exclusively and will contact you directly.
• We do not guarantee that a Hauler will respond to your request or contact you.

You consent to being contacted by Haulers who are responding to your request via phone, text, or email.

6. Selecting a Hauler

When multiple haulers respond to your request, you will receive their quotes and messages through the Platform. You may:

• Review each hauler's quote, message, and any available rating information.
• Communicate with haulers through our secure messaging system before making a decision.
• Select the hauler you'd like to work with. Once selected, both you and the hauler will receive each other's full contact information to coordinate the job.

Any agreement you reach with a Hauler regarding pricing, scheduling, or scope of work is solely between you and the Hauler. 5Junk is not a party to any such agreement.

7. Reviews & Ratings

After you select a hauler and the job is arranged, you may receive an invitation to leave a review. Reviews help other customers make informed decisions and help haulers improve their service.

• Reviews include ratings for Communication, Professionalism, Speed, and Pricing.
• You may also leave optional written feedback about your experience.
• Reviews are verified — only customers associated with a confirmed hauler selection may submit a review.
• One review is permitted per job request.
• Reviews must be honest, factual, and not contain hate speech, threats, or fabricated content.

8. No Guarantee of Service

5Junk does not guarantee that: (a) any Hauler will respond to your request; (b) you will receive a phone call, quote, or service offer; (c) any service performed by a Hauler will meet your expectations; or (d) a Hauler will be available in your area at your preferred time.

9. Cost to Customers

Submitting a request on 5Junk is completely free. You will never be charged by 5Junk for using the Platform. Any charges for junk removal services are negotiated directly between you and the Hauler.

10. Prohibited Conduct

You agree not to:

• Submit false, misleading, or spam requests.
• Use the Platform for any illegal purpose.
• Impersonate another person or provide contact details of someone who has not consented.
• Use automated scripts or bots to interact with the Platform.
• Harass, threaten, or abuse any Hauler who contacts you.
• Submit fabricated or malicious reviews intended to harm a hauler's reputation.
• Submit more than 5 requests per hour (rate-limited by system).

11. Intellectual Property

All content on the Platform — including logos, text, graphics, software, and design — is owned by or licensed to 5Junk and is protected by copyright and trademark laws. You may not copy, reproduce, or distribute any part of the Platform without prior written consent.

By uploading photos or videos to the Platform, you grant 5Junk a non-exclusive, royalty-free license to use that media for the purpose of presenting the job to Haulers. Video walkthroughs are automatically deleted within 48 hours after your lead is fully claimed, for your privacy.

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 5JUNK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM OR ANY SERVICES ARRANGED THROUGH IT.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED $100.

14. Indemnification

You agree to indemnify and hold harmless 5Junk, its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your breach of these Terms; (c) your interaction with any Hauler; (d) any content you submit through the Platform, including reviews; or (e) your violation of any applicable law.

15. Account Termination

We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violations of these Terms, suspected fraud, submission of malicious reviews, or abusive behavior. Upon termination, your right to use the Platform ceases immediately.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any disputes arising from or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in California. You agree to waive any right to a jury trial or participation in a class action.

17. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
